Fragmentation of services and 15% reduction in work meant no TUPE transfer In Enterprise Management Services Ltd v Connect-Up Ltd [2012] IRLR 190 EAT, the EAT held that there was no TUPE transfer to a new contractor where the services carried out by the original contractor were spread out among several providers, and the new contractor carried out around 15% less of the work carried out by the original contractor.
