- "Industrial relations" concerns alone cannot justify unequal pay In Kenny and others v Minister for Justice, Equality and Law Reform, Minister for Finance, Commissioner of An Garda Síochána C-427/11 ECJ, the European Court of Justice (ECJ) held that keeping differences in pay in the "interests of good industrial relations" cannot, by itself, be a sufficient justification, although can be one factor taken into account if there are other justifications.
