- Oral assurances during contract negotiations trumped written terms In Thinc Group v Armstrong and another [2012] EWCA Civ 1227 CA, the Court of Appeal held that oral assurances during negotiations that took place before a contract for services in the financial sector was signed trumped the written contractual terms. - Dismissal of police worker who withheld information on criminal brother In DA v Strathclyde Joint Police Board [2012] CSIH 75 CS, the Court of Session considered the case of the dismissal of a police worker whose brother had been convicted of sex offences. The police worker knew where his brother was, but kept this from the police. The Court of Session has now said that the EAT "clearly stepped outside its jurisdiction and approached the case as if it were a tribunal of first instance" and sent the case to be reheard by a new tribunal.
