Unfair dismissal: Previous incident was relevant to decision to dismiss In London Borough of Brent v Fuller EAT/0453/09, the EAT held that, when deciding whether or not to dismiss an employee for misconduct, the employer was entitled to take into account a similar previous incident for which she had not been disciplined. (Personnel Today)
