- Working time: Workers must be able to postpone paid annual leave on becoming sick In Asociación Nacional de Grandes Empresas de Distribución (ANGED) v Federación de Asociaciones Sindicales (FASGA) and others [2012] IRLR 779 ECJ, the European Court of Justice (ECJ) held that the Working Time Directive prohibits national measures that do not allow workers who become sick during paid annual leave to take that annual leave at a later time.
- Working time: Court of Appeal rules on holiday pay for workers on long-term sick leave In NHS Leeds v Larner [2012] IRLR 825 CA, the Court of Appeal held that a worker on long-term sick leave was entitled to carry forward untaken paid annual leave. There was no legal requirement for her to submit a request to do so. On termination of her employment she was entitled to payment in lieu of the untaken leave that had been carried forward.
