Consequential age discrimination amendments
The government has published Regulations, coming into force on 6 April 2007, that amend some provisions of the Employment Equality (Age) Regulations 2006.
The Employment Equality (Age) (Consequential Amendments) Regulations 2007 make changes to the age discrimination legislation that came into force on 1 October 2006.
The Regulations make it unfair to dismiss an employee for exercising, or seeking to exercise, the right to be accompanied, or to accompany another, at a meeting under the prescribed 'duty to consider' retirement procedure.
In addition, they amend the Employment Act 2002 (Dispute Resolution) Regulations 2004 so that, where an employee believes that disciplinary action brought by an employer constitutes age discrimination, the employee may initiate a grievance under the statutory grievance procedure. They also clarify that the statutory age discrimination questionnaire does not constitute a grievance under the statutory grievance procedures.
