We provide a round-up of case reports added to HR & Compliance Centre this week, covering: equal pay; TUPE; and religious discrimination. 

  • Equal pay: No requirement for a "single source" under Equal Pay Act 1970 In North Cumbria Acute Hospitals NHS Trust v Potter and others [2009] IRLR 176 EAT, the EAT held that, although equal pay comparisons under art.141 must be between individuals whose pay is attributable to a single source, this requirement does not apply to claims brought under the Equal Pay Act 1970, provided that the comparator is in "the same employment" as the claimant within the meaning of the Act. (Employment Review)
  • TUPE: Duty to consult ends with transfer In Amicus and another v City Building (Glasgow) LLP and others [2009] IRLR 253 EAT, the EAT held that, after a transfer, the transferee employer is not obliged to consult with representatives of the transferred employees in respect of the measures that it proposes to take. (Employment Review)
  • Dismissal for promoting Christianity not discriminatory In Chondol v Liverpool City Council EAT/0298/08, the EAT held that a social worker who was dismissed for promoting his religious beliefs to service users did not suffer religion or belief discrimination. (Personnel Today)
