Contracting-out of TUPE: change in service provision proves critical In OCS Group UK Limited v Jones and another EAT/0038/09, the Employment Appeal Tribunal held that the sale of pre-prepared sandwiches in kiosks was a wholly different operation to the provision of a full canteen service, and a service provision change under reg.3(1)(b) of the Transfer of Undertakings (Protection of Employment) Regulations 2006 had not therefore occurred.
