We provide a round-up of case reports added to HR & Compliance Centre this week, covering: unfair dismissal and reinstatement; contracts of employment; and unfair dismissal compensation. 

  • Unfair dismissal: Employment tribunal erred in ordering reinstatement In Central & North West London NHS Foundation Trust v Abimbola EAT/0542/08, the EAT held that the employment tribunal had wrongly excluded highly relevant factors from its consideration of whether or not it was practicable to order reinstatement following a finding of unfair dismissal. (Employment Review)
  • Contracts of employment: Contract was terminated not consensually varied In Rogers v Microblade Ltd EAT/0041/09, the EAT held that an employee's contract of employment was terminated, not consensually varied, when the employee refused to accept changes to his shift pattern and the employer wrote to inform him that his old contract would end and that he would be re-engaged on the new terms when he signed a new contract. (Employment Review)
  • Tribunal rules new job broke the chain of causation in pension claim In Aegon UK Corp Services Ltd v Roberts [2009] EWCA Civ 932 CA, the Court of Appeal held that there was no basis for distinguishing between the various heads of compensation and giving pension loss special status. (Personnel Today)
