  • Tribunal retains broad discretion to extend time limit   In Copus v Pendragon plc (trading as CD Bramall Bradford) [2005] All ER (D) 42 (Aug) EAT, the Employment Appeal Tribunal held that an employment tribunal had a broad discretion to extend a time limit where it was just and equitable to do so. (Personnel Today)

  • Penalty clause was enforceable   In Murray v Leisureplay plc [2005] All ER (D) 428 (Jul) CA, the Court of Appeal held that a clause in a service agreement that the company would pay him one year's gross salary, pension contributions and other benefits in kind if his employment was terminated without the required notice was enforceable. (Personnel Today)
