  • Tribunal failed to consider balancing factors on job share refusal   In Craddock v Cornwall County Council and another [2005] All ER (D) 278 (Dec) EAT, the Employment Appeal Tribunal held that, when considering whether an employee had been discriminated against when she was refused a request to job share after returning from maternity leave, an employment tribunal had failed to look at the balance between the discriminatory effect of the refusal and the justification for it.
