  • Last straw does not have to be breach of trust and confidence in itself  In Barke v Seetec Business Technology Centre Ltd [2006] All ER (D) 41 (Jan) EAT, the Employment Appeal Tribunal held that, when considering whether conduct by an employer amounted to the 'last straw' for the purposes of constructive dismissal, the events should cumulatively amount to a breach of the implied term of trust and confidence.
