  • Different treatment for employees committing same offence can be fair   In Enterprise Liverpool plc v Bauress and another EAT/0645/05, the Employment Appeal Tribunal held that two employees were not unfairly dismissed when the employer had allowed another employee to keep his job after committing the same offence, as there were different circumstances in the earlier case.
