• Employer's defence struck out for repeated failure to exchange documents   In Premium Care Homes Ltd v Osborne EAT/0077/06, the Employment Appeal Tribunal held that an employment tribunal was correct to strike out an employer's defence to an unfair dismissal claim when it failed to provide the employee with documents such as witness statements, causing the hearing to be postponed on more than one occasion.
