In Postcastle Properties Ltd v Perridge [1985] 276 EG 1063 CA, the Court of Appeal held that an occupier of premises who had been the employee of the then owners when his occupation began was a tenant. Whether or not he had originally been granted a tenancy or a licence, the evidence showed the grant by the subsequent owners of a service tenancy.

In Poulton v Walton [1998] ET/1805515/97, the employment tribunal found that an employee with diabetes controlled by diet was disabled. Diet was a 'measure' taken to treat the diabetes so the effect of following the diet had to be ignored in considering whether he was disabled. He was not discriminated against in respect of his disability since the dismissal was not for a reason related to his disability.

In Power v Greater Manchester Police Authority EAT/0087/10, the EAT affirmed that, in determining whether or not an employee has suffered direct religious discrimination, a distinction may be drawn between treatment on the ground of the person's beliefs and treatment on the ground of manifestation of those beliefs.

In Power v Panasonic UK Ltd the EAT holds that In deciding whether a complainant has a disability within the meaning of the Disability Discrimination Act 1995, an employment tribunal should consider whether the disability alleged is one that falls within the meaning of the Act, or whether it is in fact an impairment which is excluded by reason of Regulations issued under the Act from being treated as such a disability.

In Prakash v Wolverhampton City Council EAT/0140/06, the Employment Appeal Tribunal holds that where a fixed-term contractor's dismissal for misconduct was overturned by an appeal decided after the expiry date of the contract, the effect of the successful appeal was to reinstate the terms of the original contract. It could not extend the life of the contract beyond its expiry date.
