Equal pay: A long-running controversy in equal pay law is about whether an employer must always provide an objective justification for a pay difference in order to satisfy the material factor defence under section 1(3) of the Equal Pay Act, or whether it is only necessary to have an objectively justified reason where there is indirect discrimination.
