Case report round-up: Direct discrimination claim for same allegations as failed disability-related claim

Disability discrimination: direct and disability-related In JP Morgan Europe Ltd v Chweidan EAT/0286/09, the EAT held that, if a claim of disability-related discrimination fails, it is difficult to see how the same allegations could found a successful claim for direct discrimination. Where an allegation of disability-related discrimination is dismissed because a comparator would have been treated in a like way, there has been no less favourable treatment, and so a direct discrimination claim must also fail. (Personnel Today)
