In Secretary of State for Trade and Industry v Bottrill 12.2.99 Court of Appeal, the Court of Appeal upholds an employment tribunal's finding that a controlling shareholder of a company could also be an employee of that company for the purposes of the employment protection legislation. Whether or not such an individual is an employee can only be decided by having regard to all the relevant facts.
