In Hayward v Cammell Laird Shipbuilders Limited the House of Lords rules that a successful equal pay claimant is entitled to have each distinct term in her contract of employment modified so that it is no less favourable than the corresponding term in her comparator's contract. The Lords overturn the judgment of the Court of Appeal ([1987] IRLR 186; IRLIB 327), which considered that no modification of a claimant's contract is required if her overall remuneration, including such items as sickness and holiday pay, is worth as much as her comparator's.
