In Akzo Coatings plc v Thompson and others 14.2.96 EAT 1117/94, the EAT holds that an industrial tribunal erred in law in applying the guidelines on redundancy selection in Williams and others v Compair Maxam Ltd [1982] IRLR 83 to the way in which an employer dealt with the possibility of alternative employment for redundant employees. Those guidelines have no application when considering whether the employer has taken reasonable steps to look for alternative employment. Similarly, in Mallon v Lothian Health Board 23.5.96 (S) EAT 1278/95, the EAT holds that the Compair Maxam guidelines were not apt and an employer was entitled to ignore its redundancy policy.
