Preventing bribery: The Bribery Act and its guiding principles
Authors: Edward Goodwyn and Neil McInnes, partners at Pinsent Masons
Overview
This series of Leading practice guides discusses the steps HR can take to help deter bribery in their organisation. In this guide, we discuss the duties the Bribery Act 2010 places on organisations to prevent bribery and the consequences of failing to do so. Other guides in the series:
- Preventing bribery: Identifying and addressing key risk areas
- Preventing bribery: Raising awareness
- Preventing bribery: HR policies and documentation
- Preventing bribery: Taking action where bribery is identified
To ensure that appropriate measures are in place to prevent bribery, employers should consider taking the steps set out in this series of guides in conjunction with other anti-corruption measures. The anti-corruption programme should not be the sole responsibility of the HR department. It should have the commitment of senior management, and may need to involve, for example, in-house lawyers, the company secretary, the internal auditor, the finance director, commercial directors and procurement managers.
