Fair Work Agency begins statutory holiday pay enforcement

Implementation date: Expected 2027

While the Fair Work Agency (FWA) launched on 7 April 2026, it is rolling out its enforcement activities gradually. The Government has said that statutory holiday pay will be enforced by the FWA from 2027.

State enforcement of statutory holiday pay is introduced for the first time by the Employment Rights Act 2025. Until the FWA takes up its responsibility, holiday pay is enforced only by individuals taking action against their employer, for example through the employment tribunal.

In its consultation, Make Work Pay: holiday pay compliance and enforcement, the Government confirmed that FWA enforcement of holiday pay will start from 2027, but the exact date is not yet known.
