Strengthening of blacklisting protections

Implementation date: Expected 2027 

The Employment Rights Act 2025 introduces measures to extend and strengthen blacklisting protections to cover:

  • lists created by predictive technology;
  • lists that are not prepared with discriminatory intent but that are used for that purpose; and
  • lists compiled by third parties.

According to the Government's factsheet, a public consultation on blacklisting is expected to launch in Spring 2026.

In its updated timeline for the implementation of the Employment Rights Act 2025, the Government has confirmed that these measures will take effect in 2027.
