Case report round-up: EAT upholds tribunal decision that police officer who displayed violent tendencies was not discriminated against
XpertHR's latest case reports cover:
- Victimisation: Compensation for injury to feelings and aggravated damages In St Andrews Catholic Primary School and others v Blundell EAT/0330/09, the EAT held that the appropriate award of compensation for injury to a victimised employee's feelings was £14,000, not £22,000, reflecting that it was a serious case falling within the middle Vento band. The tribunal's award of £5,000 in aggravated damages was, however, appropriate. (Employment Review)
- Disability discrimination: Police force did not discriminate against officer who appeared to present danger to colleagues and public In Aitken v Commissioner of Police of the Metropolis EAT/0226/09, the EAT held that, in assessing whether or not a police officer who had displayed violent tendencies had been discriminated against, the employment tribunal was entitled to have regard to the need for a police officer not to appear to present a danger to colleagues or the public.
