In Campbell v Sheffield Teaching Hospitals NHS Foundation and another, the Employment Appeal Tribunal (EAT) held that the trust had taken all reasonable steps to prevent an employee making a racially abusive comment to the union branch secretary and that it did not take place in the course of his employment.
