When to use this redundancy flowchart
Use this redundancy flowchart to carry out an election of employee representatives for collective redundancy consultation purposes in accordance with the requirements of the Trade Union and Labour Relations (Consolidation) Act 1992, where there is no independent trade union recognised in respect of the affected employees.
The flowchart should be used where the employer is required to consult collectively because it is proposing to dismiss as redundant 20 or more employees within a 90-day period.
Because "redundancy" for the purposes of the duty to consult collectively covers dismissal for any reason not related to the individual, it includes the situation where the employer is proposing to dismiss (and offer re-engagement to) employees who do not agree to a proposed change to their terms and conditions.
