Germany: Federal Labour Court upholds right to sympathy strikes

A recent ruling by the Federal Labour Court appears to have overturned the German courts’ long-standing position that secondary or sympathy industrial action is not lawful.

German law on industrial action has overwhelmingly been shaped by court rulings interpreting those provisions of the constitution (or Basic Law) that provide for the right to “form associations to safeguard and improve working and economic conditions”.
