Legislation: MHSW rethink will allow workers to sue employers

The Government is to amend the Management of Health and Safety at Work Regulations 1999 (MHSW) and the Fire Precautions (Workplace) Regulations 1997 to allow employees to sue their employer for a breach of the Regulations. Both currently contain a "civil liability exclusion" prohibiting such an action.

The MHSW Regulations (see The Management of Health and Safety at Work Regulations 1992) require employers, among other things, to carry out a risk assessment.
