Ascertain if collective redundancy consultation is necessary
Key points
Where an employer is proposing to dismiss as redundant 20 or more employees at one establishment within a period of 90 days or less, it is required to consult with the appropriate representatives of the affected employees.
In calculating whether or not 20 or more employees will be dismissed as redundant, the employer should include employees who volunteer for redundancy.
Even if collective redundancy consultation is not required by law, it is good practice for the employer to consult with representatives of the affected employees.
