The facts
During the course of his employment with the respondents, Mr Milsom was advanced the sum of £111.68 to cover examination fees, travelling, subsistence etc in connection with a diploma he was taking in consumer protection. One of the terms on which these advances were made was that if he failed the exams or left the respondents' employment within a certain length of time after taking them, he would have to refund the money.
