When to use this model neonatal care leave form
Use this model form to allow an employee to provide a notice of entitlement and intention to take neonatal care leave (and pay, where relevant) in respect of a child adopted within the UK. This version of the form is a preliminary draft reflecting reforms that will be introduced by the:
- Neonatal Care (Leave and Pay) Act 2023;
- Neonatal Care Leave and Miscellaneous Amendments Regulations 2025 (in draft - Parliamentary approval needed); and
- Statutory Neonatal Care Pay (General) Regulations 2025 (in draft - Parliamentary approval needed).
Although the Act has been brought into force, the Government still needs to introduce secondary legislation in the form of regulations for the amended rights in the Act to be fully operational. The draft Regulations have been laid before Parliament and are due to come into force on 6 April 2025. This form is written on the basis that the draft Regulations will be passed without any modification. However, there may be further changes to the Regulations before they are finalised. Therefore, further revisions to this form may be necessary.
