When to use this model paternity leave letter
Use this model letter to inform an employee that they are not eligible for statutory paternity leave or pay.
This letter applies to employees covered by the rules in place prior to the introduction of the day-one right to paternity leave on 6 April 2026. It should be used where:
- the expected week of childbirth is before 5 April 2026 and the child is born before 6 April 2026; or
- the child is expected to be placed for adoption with the adopter (or enter Great Britain for adoptions from overseas) before 6 April 2026.
