Case report round-up: No jurisdiction to interpret annual leave term

- Equal pay: Not necessary to show "real possibility" of comparator from different establishment doing same work at claimant's establishment for comparator to be "in the same employment" In North and others v Dumfries and Galloway Council [2011] IRLR 239 CS, the Court of Session held that the EAT's "real possibility" test incorrectly placed an additional hurdle on claimants and amounted to an error of law. - Contracts: Tribunal had no power to construe contractual terms In Southern Cross Healthcare Co Ltd v Perkins and others [2011] IRLR 247 CA, the Court of Appeal held that an employment tribunal had no jurisdiction to interpret a term of the employee's contract relating to his entitlement to annual leave.
